HB 1637- BaCote, Brink and Toscano – relating to restoration of parental rights. This bill would create procedure for restoring parental rights to a parent whose rights to their child have previously been terminated when the child is at least 14 years of age and the child has not achieved his permanency goal. Bill also provides for appointment of a special advocate to provide services for the juvenile in the proceeding. HB 1723- Toscano (SB 718)- child support, imputation of income and enrollment in educational or vocational program: a parent’s decision to enroll and complete an educational or vocational program will be a factor in determining whether to impute income for purposes of child support obligations. HB 1743- Brink- foster children committed to the Department of Juvenile Justice and independent living services: allows local departments of social services and licensed child-placing agencies to make independent living services available to 18- 21 year olds who have been released from Department of Juvenile Justice who were committed to the care of a local board of social services when they were committed to custody of the Department of Juvenile Justice. HB 1766- Bell, R.B.- Prior sex offenses to be offered as admissible in evidence. This would mean that in a criminal case in which the defendant is accused of an offense of sexual abuse, evidence of the defendant’s conviction of another offense or offenses of sexual abuse is admissible and may be considered for its bearing on any matter to which it is relevant. HB 1821- Iaquinto- Child Pornography Images Registry and exemptions from disclosure, etc. which would exempt records relating to child abuse and exploitation in possession of the Department of State Police from the Virginia Freedom of Information Act and the Government Data Collection and Dissemination Practice act and that the Registry is not subject to the Virginia Information Technology Agency, therefore exempting the records from access. HB 2193- Merricks- relating to child abuse investigations and school division employees: expands the class of individuals that a local department of social services has to report to a local school board when determining that there is an alleged complaint re: child abuse or neglect to include applicants for any full-time, part-time, permanent or temporary teacher or employee of a school division. SB 667- Garrett- child endangerment penalty, currently it is Class 4 felony for any parent, guardian, etc., either by willful act  or omission, to cause or permit serious injury to a child. A parent, guardian, or other caretaker whose willful act or omission in the care of a child was so gross, wanton, and culpable as to show reckless disregard for human life is guilty of a Class 6 felony. SB 746- Stanley- abuse and neglect of a child and penalty for any parent or other person responsible for the care of a child under 12 years old to fail or report within a reasonable time, to law enforcement about a missing child. Failure to do so is believed to be due to intent to conceal the fact of the missing child. SB 862- Favola- Extends the time frame from 90-180 days for a person between 18 and 21 to request re-entry into foster care and independent living services after electing to leave. SB 960- Barker- determining residency of public school students, which would allow for a child who has “kinship care” from an adult relative to enroll in the school division where the kinship care provider resides, the bill would also request that one legal parent and kinship care provider to sign official declaration detailing the kinship care arrangement and for the adult relative to make educational decisions regarding the child. SB 1004- Howell- relating to landlord and tenant law and early termination of rental agreements by victims of family abuse or sexual assault, in such cases as a victim of (i) family abuse, (ii) sexual abuse, or (iii) criminal sexual assault may terminate a rental agreement under certain circumstances. The bill discusses the instances under which termination may be sought and the process that must be followed by the tenant to effect the termination. SB 1031- Reeves- relating to use of communication systems to facilitate certain offenses involving children; the bill would expand the existing offense to include that it would be unlawful for an adult (18 years of age or older) using a communication system, including computers, computer networks, bulletin boards, or any other electronic means, for the purposes of soliciting, with lascivious intent, proposing to the child younger than 15 years of age that the child feel or fondle his or her own sexual or genital parts.
